Dispute resolution.
If disputes cannot be avoided, dispute resolution is our speciality. We act in construction and infrastructure disputes involving delay, defects, payment, variations, liquidated damages, termination, performance guarantees and performance bonds.
We also advise and act in MCST, strata-title and residential property defects claims involving common property defects, breach of statutory and contractual duties, professional negligence, water ingress, façade issues, waterproofing, and developer/contractor responsibility. These disputes often require careful handling of limitation, warranties, expert evidence, and the developer/main contractor/sub-contractor chain, including issues arising from the independent contractor defence.
Our lawyers are also thoroughly familiar with the adjudication regime under the Building and Construction Industry Security of Payment Act 2004.
